Personal Injury Law - No person ever expects to become injured in an accident, but when it happens, our system of justice allows those victims to seek compensation for the harm, and, if necessary, a trial by a jury of their peers. The San Diego personal injury lawyers at Walton Law Firm represent accident victims throughout Southern California, and in cities such as Escondido, Poway, Temecula, Oceanside and Encinitas. Our injury attorneys have recovered millions of dollars for individuals involved in a variety of personal injury claims, including car accidents, motorcycle accidents, pedestrian injuries, uninsured motorist claims, defective products, construction accidents, slip and fall injuries, dog bites, insurance disputes, and medical malpractice suits.

Car Accident Law – There is no question that car accident cases make up a large part of any personal injury lawyer’s caseload. Car accidents occur with high frequency, too often produce injury, and cause major disruptions in the lives of those involved. The typical car accident that causes injury is the rear-ender, that results in neck and back injury, but there a wide variety of ways auto accidents occur. The most severe injuries tend to arise in cases of head-on or T-bone collisions. The mechanics of those accidents are more likely to produce bone fractures, injuries to joints, or concussions/brain injury. In California, any negligent driver is responsible for all damages caused by an accident, including payment of the injured party’s medical bills, lost wages, and pain and suffering damages.

Wrongful Death Law – The worst type of personal injury case, of course, is the case of wrongful death. In California, the code of civil procedure allows for the surviving spouse, domestic partner, children, and issue of deceased children to maintain a case when a person is killed by the conduct of another. At Walton Law Firm we see them too frequently in the automobile and motorcycle accident context, but these tragedies can happen anywhere, such as construction sites, nursing homes, swimming pools, and innumerable other places. After any unexpected death, it is important that a thorough investigation is conducted as soon as possible after the event to preserve all evidence to be used in the case.

Elder Abuse and Neglect Law - Physical abuse or neglect in the nursing home, residential care, or assisted living setting is the basis for a substantial part of the Walton Law Firm law practice, and they take cases in all Southern California counties. Elder neglect typically involves the failure to provide adequate care, and includes bed sores, fractures, dehydration, malnutrition, inadequate staffing or supervision, or any other action that causes injury, illness, or death. Insurance Law - While we all pay insurance premiums to protect us when coverage is needed, insurance companies frequently deny legitimate claims when we need them the most. Walton Law Firm represents policyholders, individuals and businesses in a wide variety of insurance matters to make sure insurance companies provide the benefits promised in their insurance policies. Whether the insurance company has wrongfully denied a claim, underpaid the claim, or delayed payment of policy benefits, our attorneys have the knowledge and experience to advise our clients of their rights and help them to obtain a full recovery.

What Is My Case Worth? This, of course, is the ultimate question for every personal injury victim, but the answer is rarely straightforward. In cases involving relatively minor injuries, some lawyers (and insurance companies) will use a type of multiplier, taking the medical bills and multiplying them by two or three. That equation doesn’t work in every case, and in many cases should be view with skepticism. There are many cases where the medical bills can be relatively low, but the damages high, and vice versa. Whatever the injury, it is the duty of the personal injury to argue for the highest case value possible depending the unique injuries and issues of every case.
