As the nursing home and residential care population continues to grow, primarily among the segment suffering from Alzheimer's disease or dementia, peer-on-peer abuse is becoming more prevalent. Any nursing home that admits residents with dementia or Alzheimer's, or any other psychological disorder that may have violent tendencies, has a duty to evaluate each resident for their tendency for abuse on others, and prepare an adequate plan-of-care.
Nursing home residents have a right to be free from abuse, whether it's at the hands of a caregiver or a fellow resident. Failure to protect residents may expose the nursing home to legal liability.
